1. Acceptance of Terms

1.1 Agreement

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Catto Intelligence Platform ("Catto", "we", "us", or "our") governing your access to and use of the Catto intelligence aggregation platform, including our website, APIs, and all related services (the "Service").

By accessing or using the Service you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service.

1.2 Eligibility

• You must be at least 18 years old.
• You must have the legal capacity to enter into binding contracts.
• You must not be prohibited from using the Service under applicable law.
• Your use must comply with the laws of your jurisdiction.

1.3 Entity Accounts

If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms and that the organisation agrees to be bound.

2. Description of Service

2.1 Core Functionality

Catto provides a real-time intelligence aggregation platform that:

• Aggregates data from 50+ open-source intelligence feeds covering geopolitical, aviation, maritime, cyber, seismic, and emergency domains.
• Displays global events, conflict incidents, aircraft and vessel tracking, seismic and wildfire data, and cyber threat intelligence.
• Provides war-prediction and escalation-risk analysis across 23 global regions.
• Offers customisable alerts, keyword monitors, and VIP watchlists.
• Maintains historical intelligence archives with search and export.
• Surfaces entity-linked intelligence (sanctions, PLAN/CCG vessels, threat-actor profiles, MITRE ATT&CK campaigns).

2.2 Subscription Tiers

Free Tier

• Core access to intelligence feeds.
• 7-day intelligence history retention.
• Limited map, tracking, and correlation features.
• One concurrent session.

PRO Tier

• Full access to all intelligence feeds and modules.
• Unlimited intelligence history retention.
• War Prediction Engine (all 23 regions).
• VIP aircraft and vessel tracking.
• Custom keyword monitors and alert thresholds.
• SIGINT operations (DARKINT, ELINT, COMINT).
• Priority Intelligence panel.
• Entity linking and threat-actor profiles.
• Panel layout customisation and export capabilities.
• Multiple concurrent sessions.

2.3 Service Availability

While we strive for continuous availability, we do not guarantee:

• 100% uptime or uninterrupted operation.
• Error-free operation.
• Availability of any specific third-party data feed.
• Real-time delivery (feeds have inherent delays).

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice.

3. User Accounts and Registration

3.1 Account Creation

To access the Service, you must create an account by providing a valid email, a username, and a secure password, or by authenticating via Google or GitHub OAuth. You agree to provide accurate, current, and complete information during registration and to keep it up to date.

3.2 Account Security

You are responsible for:

• Safeguarding your password.
• Enabling two-factor authentication (2FA) where possible.
• Storing 2FA backup recovery codes securely.
• All activity under your account, authorised or not.

Notify us immediately at [email protected] if you suspect unauthorised access.

3.3 Account Restrictions

You may not:

• Create more than one account without our prior written consent.
• Create an account on behalf of another person without authorisation.
• Use another user's account without permission.
• Share your account credentials.
• Sell, transfer, or sublicense your account.

3.4 Account Deletion

You may delete your account at any time via Settings → Account → Delete Account. Upon deletion:

• Your personal data will be permanently deleted within 30 days.
• Your intelligence history will be deleted.
• Active subscriptions will be cancelled with no refund for unused time.

4. Subscription and Billing

4.1 PRO Subscription Plans

Prices are subject to change with 30 days' notice to active subscribers.

4.2 Free Trial

• Duration: 7 days from subscription start.
• Payment method: required to begin the trial; Stripe may place a $0 authorisation to verify the card.
• Automatic billing: you will be charged when the trial ends unless you cancel beforehand.
• Cancellation during trial: cancel any time during the trial to avoid charges; you keep PRO access until the trial ends.
• One trial per user and per payment method.

4.3 Automatic Renewal

PRO subscriptions automatically renew at the end of each billing cycle unless cancelled. You authorise us (via Stripe) to charge your payment method at the end of the trial and at the end of each billing cycle. An invoice is emailed after each successful payment.

4.4 Payment Processing

All payments are processed by Stripe, Inc. By subscribing you agree to Stripe's Terms of Service, to provide accurate payment information, and to keep it current. We do not store full credit-card details; Stripe stores payment information in accordance with PCI-DSS standards.

4.5 Failed Payments

• You will be notified by email.
• Your account will be marked past_due.
• Stripe will retry the payment (typically three times over two weeks).
• Continued failure will cancel the subscription and downgrade you to the Free tier.
• You remain responsible for any unpaid amounts.

4.6 Cancellation Policy

• How: Settings → Subscription → Manage Billing (Stripe Customer Portal).
• Effective: end of your current billing period.
• Access: PRO features remain available until the period ends.
• Downgrade: automatic to Free tier afterwards; intelligence history beyond 7 days is deleted 30 days after downgrade.

4.7 Refund Policy

All subscription fees are non-refundable. We do not provide refunds or credits for partial billing periods, unused time on quarterly or yearly subscriptions, downgrades, or for service disruptions except as required by law.

Refunds may be granted at our sole discretion for:

• Billing errors or duplicate charges.
• Fraudulent transactions.
• Extended service outages exceeding 72 hours.

To request a refund in these cases, contact [email protected] within 14 days.

4.8 Price Changes

• Notice: at least 30 days before any price change.
• Grandfathering: your current price is locked until the end of your current billing cycle.
• Cancellation option: you may cancel before the new price takes effect.
• Continuing to use the Service after the price change constitutes acceptance.

5. Acceptable Use Policy

5.1 Prohibited Uses

You agree NOT to use the Service to or for:

Illegal Activities

• Any activity violating local, national, or international law.
• Facilitating or planning terrorism, violence, or fraud.
• Violating export-control or sanctions regimes.
• Stalking, harassing, or threatening individuals.

Unauthorised Access

• Attempting to gain unauthorised access to our systems or databases.
• Accessing another user's account without permission.
• Probing, scanning, or testing system vulnerabilities without authorisation.
• Circumventing authentication or rate-limiting controls.

Service Abuse

• Scraping: automated scraping or extraction of data from the Service.
• API abuse: exceeding documented rate limits.
• Denial of service: overloading our infrastructure intentionally or otherwise.
• Reverse engineering or decompilation of the Service.
• Using Catto data to build a competing aggregation platform.

Content Violations

• Uploading malicious code, viruses, or malware.
• Transmitting spam, phishing, or unsolicited communications.
• Posting illegal, defamatory, or infringing content.

Resale and Redistribution

• Reselling access to the Service.
• Redistributing aggregated intelligence data to third parties commercially.
• Creating derivative works based on Catto's aggregation.

5.2 Acceptable Uses

The Service is intended for legitimate intelligence gathering and analysis, including:

• Security research and threat analysis.
• OSINT investigations.
• Journalism and investigative reporting.
• Academic research.
• Corporate security and risk assessment.
• Geopolitical analysis.
• Travel safety and situational awareness.

5.3 Enforcement

We reserve the right to investigate and take action against violators, including:

• Warnings.
• Temporary suspension of accounts.
• Permanent termination of accounts without refund.
• Reporting violations to law enforcement.
• Pursuing legal action for damages.

6. Intellectual Property

6.1 Catto's Intellectual Property

The Service, including its code, design, user interface, features, documentation, and branding, is owned by Catto Intelligence Platform and protected by copyright, trademark, and trade-secret laws.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your personal or internal business purposes. You may not:

• Copy, modify, distribute, sell, or lease any part of the Service.
• Reverse engineer or attempt to extract the source code.
• Remove or alter proprietary notices.
• Use our trademarks or branding without written permission.

6.2 Third-Party Data

Intelligence data displayed in Catto is aggregated from third-party OSINT feeds. The data is not owned by Catto; it remains the property of its original publishers and may be subject to each publisher's terms. Most sources provide data under open licences, public-domain dedications, or permissive terms.

You may use intelligence data from Catto for:

• Personal research and analysis.
• Internal business purposes.
• Journalism and reporting (with attribution to the original source).
• Academic research.

You may not:

• Resell or redistribute Catto's aggregated intelligence data commercially.
• Use the data to build a competing intelligence platform.
• Scrape data in bulk for purposes other than personal use.
• Claim ownership of data sourced from third parties.

6.3 User-Generated Content

You retain ownership of content you create using the Service (custom alerts, saved searches, notes, watchlists). You grant Catto a worldwide, royalty-free licence to store and process your content to operate the Service and to generate anonymised, aggregate statistics. We do not claim ownership of your content and will not share it with third parties except as described in the Privacy Policy.

6.4 Copyright Complaints

If you believe content on Catto infringes your copyright, send a takedown notice to [email protected] including the copyrighted work, the infringing material's location, your contact details, a good-faith statement, a statement under penalty of perjury of accuracy, and your signature.

7. Data Accuracy and Disclaimers

7.1 Third-Party Data Sources

Catto aggregates data from third-party sources. We do not create, verify, or guarantee the accuracy of this data. Feeds may contain errors or delays, go offline, or change format without notice.

7.2 War Prediction and Risk Analysis

War-prediction scores and escalation-risk assessments are algorithmic estimates, not guarantees of future events. They should be used only as one input among many for situational awareness and further research.

They must not be used as:

• The sole basis for critical decisions (including travel to or from a region).
• Financial, investment, or insurance advice.
• Military or defence planning.
• Life-or-death decision-making.

7.3 Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, including warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, error-free data, or that defects will be corrected.

7.4 User Responsibility

You are solely responsible for:

• Verifying the accuracy of data before making important decisions.
• Cross-referencing intelligence with authoritative sources.
• Understanding the limitations of algorithmic risk scores.
• Complying with applicable law in your use of the Service.

8. Privacy and Data Protection

Your use of the Service is governed by our Privacy Policy, which is incorporated into these Terms by reference. In summary: we collect minimal personal information, do not sell your data, encrypt it in transit and at rest, and enable you to access, correct, export, and delete it.

9. Termination and Suspension

9.1 Termination by You

You may terminate your account at any time via Settings → Account → Delete Account. Personal data will be deleted within 30 days; active PRO subscriptions will be cancelled without refund.

9.2 Termination by Catto

We may suspend or terminate your account immediately, without notice, for:

• Violation of these Terms or the Acceptable Use Policy.
• Fraudulent activity or chargebacks.
• Abusive behaviour toward Catto staff or other users.
• Unauthorised access attempts or hacking.
• Use of the Service for illegal purposes.
• Prolonged inactivity (Free accounts inactive for 2+ years).

9.3 Effect of Termination

• Access to the Service immediately ceases.
• Active subscriptions are cancelled with no refund for unused time.
• Your data is deleted according to our retention policy.
• You remain liable for outstanding fees.

9.4 Survival

The following sections survive termination: Intellectual Property, Data Accuracy and Disclaimers, Limitation of Liability, Indemnification, and Dispute Resolution.

10. Limitation of Liability

10.1 Excluded Damages

TO THE FULLEST EXTENT PERMITTED BY LAW, CATTO SHALL NOT BE LIABLE FOR:

• Indirect, incidental, consequential, special, or punitive damages.
• Loss of profits, revenue, data, or business opportunities.
• Cost of procuring substitute services.
• Damages arising from reliance on intelligence data or war-prediction scores.
• Damages caused by third-party data sources.
• Service interruptions, downtime, or data loss.
• Unauthorised access resulting from your failure to secure credentials.

10.2 Cap on Liability

IN NO EVENT SHALL CATTO'S TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO CATTO IN THE 12 MONTHS PRECEDING THE CLAIM. For Free-tier users, total liability is capped at USD $100.

10.3 Basis of the Bargain

You acknowledge that these limitations are a fundamental basis of the bargain between you and Catto and that the Service would not be provided without them.

10.4 Exceptions

Some jurisdictions do not allow certain exclusions or limitations of liability. In such jurisdictions, our liability is limited to the fullest extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Catto and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to:

• Your use or misuse of the Service.
• Your violation of these Terms.
• Your violation of any law or regulation.
• Your violation of any third-party rights.
• Your reliance on intelligence data or war-prediction scores.
• Any actions you take based on information from the Service.

This indemnification survives termination of these Terms.

12. Dispute Resolution

12.1 Governing Law

These Terms are governed by and construed in accordance with the laws of Singapore, without regard to its conflict-of-law principles.

12.2 Jurisdiction and Venue

You agree that any dispute arising out of or related to these Terms or the Service shall be resolved exclusively in the courts of Singapore, and you submit to the personal jurisdiction of those courts.

12.3 Informal Resolution

Before initiating legal action, you agree to first attempt to resolve disputes informally by contacting [email protected]. We will attempt to resolve disputes within 30 days.

12.4 Arbitration (Optional)

If informal resolution fails, either party may elect binding arbitration under the Singapore International Arbitration Centre (SIAC) rules. Arbitration shall be conducted in English, in Singapore, and the arbitrator's decision is final and binding.

12.5 Class-Action Waiver

YOU AGREE TO BRING CLAIMS AGAINST CATTO ONLY IN YOUR INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be notified by email at least 30 days before the effective date; minor changes will be posted here with an updated "Last Updated" date.

Continued use of the Service after the effective date constitutes acceptance of the new Terms. If you do not agree, you must stop using the Service and may request account deletion.

14. Miscellaneous

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Catto regarding the Service and supersede all prior agreements.

14.2 Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force.

14.3 Waiver

Failure to enforce any right or provision does not constitute a waiver of that right or provision.

14.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms to any successor entity in the event of a merger, acquisition, or sale of assets.

14.5 Force Majeure

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, cyber attacks, or government actions.

14.6 Export Control

The Service may be subject to export-control laws. You agree to comply with all applicable export and import laws and not to export or transfer the Service to prohibited countries, entities, or persons.
